  • Are issued in accordance with applicable EU laws or laws of jurisdictions where Avvacrypto operates.
  • Are supported by valid legal authority, such as a court order, subpoena, or regulatory demand.
  • Comply with international frameworks for cooperation, such as mutual legal assistance treaties (MLATs), when requests originate from outside the EU.

Requests that do not meet these criteria will be declined.


2. Types of Data Available

Avvacrypto may provide the following types of user data in response to valid legal requests:

  • Registration date
  • Verification status

b. Transactional Information

  • Deposit and withdrawal records
  • Cryptocurrency trading history
  • Wallet addresses and balances
  • Fiat transaction details (where applicable)

c. Logs and Activity

  • Account activity logs

Avvacrypto will only provide data that is strictly necessary for the purposes outlined in the request.


3. Submitting a Request

Law enforcement agencies must submit requests through official channels, including:

  • Written Requests: Requests must be submitted on official letterhead and signed by an authorized officer.
  • Contact Information: Include full details of the requesting authority, including name, contact details, and jurisdiction.
  • Specificity: Requests must clearly specify the data sought, the purpose of the request, and the applicable legal authority.

4. User Notification

Where permissible under law, Avvacrypto will notify affected users of any law enforcement requests involving their data. Exceptions to this include:

  • Cases where notification is prohibited by law.
  • Situations where notification may compromise an ongoing investigation.

5. Cross-Border Requests

For law enforcement requests originating outside the EU:

  • Requests must comply with applicable international agreements, such as MLATs.
  • Non-EU authorities should submit requests through their local jurisdiction’s competent authority for transmission to the appropriate EU counterpart.

Avvacrypto does not respond directly to non-EU law enforcement requests unless they are validated through international cooperation mechanisms.


6. Preservation Requests

Law enforcement may request Avvacrypto to preserve specific user data for a defined period. Such requests must:

  • Be legally valid and clearly specify the data to be preserved.
  • Indicate the timeframe for preservation, subject to legal limitations.

Preserved data will remain encrypted and inaccessible until a valid request for access is received.


7. Costs and Fees

Avvacrypto may charge a reasonable administrative fee for processing law enforcement requests, especially if they involve significant effort or resources. These fees will be communicated to the requesting authority in advance.


8. Refusal of Requests

Avvacrypto reserves the right to refuse law enforcement requests that:

  • Lack proper legal authority or jurisdiction.
  • Are overly broad or vague.
  • Conflict with EU laws or the fundamental rights of users.

9. Data Retention and Limitations

Avvacrypto retains user data only for as long as necessary to fulfill its operational and legal obligations. This includes retaining transaction records for a minimum of 5 years to comply with Anti-Money Laundering (AML) and Countering the Financing of Terrorism (CFT) directives.


10. Privacy and Accountability

Avvacrypto ensures that:

  • User data is handled in accordance with GDPR principles of data minimization, transparency, and security.
  • All requests are reviewed by our legal and compliance teams before data is disclosed.
  • Records of data disclosures are maintained for accountability.
